National Post recently reported on the case of Dr. Hisham Kaloti, an Ontario dentist who is being accused of medical malpractice and battery for installing unapproved equipment in patient’s mouths.
Multiple lawsuits have been filed on behalf of former patients who have dealt with many complications since receiving their veneers and crowns. The devices were ordered from “Foo Tian Dental Laboratory,” an unregistered laboratory in China. They were allegedly installed without patient knowledge or consent, which is a requirement under Ontario’s Health Care Consent Act (HCCA).
There would have been a cost difference between the unapproved devices and the ones that are approved by Health Canada, resulting in an alleged profit for Kaloti.
The law firm representing Kaloti’s former patients are seeking damages for “alleged battery, negligence and breach of fiduciary duty, and demands punitive and aggravated damages.”
